DIRECT of OFFICER TIMOTHY BOHAC

Officer Timothy Bohac is a police officer for the city of Los Angeles.  He is assigned to property crimes.  On March 28, 2009 at 2:30AM (?) Officer Bohac was at the desk at the North Hollywood Station.  Officer Bohac took a sexual assault report from JT.  JT told Officer Bohac she felt D’s penis outside of her vagina and was penetrated with fingers/digits.  The suspect inserted a finger or two inside JT’s vagina.  JT believed D’s penis touched the outside.  JT gave D’s name and handed Officer Bohac his business card.  Officer Bohac did not ask details concerning how far.  Officer Bohac asked JT, “Did D insert his penis into your vagina.”  JT said no, it definitely touched the outside.  Officer Bohac didn’t follow up with where or how far.  He collected the clothing JT had brought with her.  JT said there was “no penetration.”

JT told Officer Bohac that prior to the incident in question she had had consensual sex with D.  Jt told Officer Bohac she sat down next to D on the couch “waiting for him to begin conversation” (bottom of pg.1). Officer Bohac interviewed JT about whether or not there was penetration and she answered, “only an attempt.”  There was “never any penetration”.  This is an elaboration after JT answered “no” to the question “Did D insert his penis into your vagina?”  JT brought clothing with her in a bag. Officer Bohac asked JT if she had any injuries. Officer Bohac thought of taking possible photos.  There were no visible injuries.  If there were others, Officer Bohac as a male officer could not take them.  JT didn’t tell Officer Bohac of further injuries.

Officer Bohac couldn’t inspect breast injuries as he is not allowed to as he is a male officer.  In his report, Officer Bohac wrote “D unsuccessfully attempted to insert his penis into her vagina.”  His penis was “touching the outer vaginal area”. Officer Bohac understands that to mean the labia. Officer Bohac wrote that because it was important to the Title of his report on commission to crime, “ATTEMPTED RAPE.”
