DIRECT of OFFICER SHANNON SMITH

Officer Smith is a Police Officer for the city of Tempe, AZ. Officer Smith  has been a law officer for 4 years.  On March 22, 2009, Officer Smith responded to a call at the Tempe Station and spoke to SL.  She took a report from SL.  She also wrote the report.  SL’s demeanor was very upset.  She was crying. Officer Smith had a hard time at first trying to understand what SL was saying as she would stop and cry then stop and cry. Officer Smith spoke to SL for an hour. Officer Smith  called Pier 71 Counsellors who work for the city to calm SL down to get the story.  SL said she was a victim of a rape.  SL named her assailant as “Alex Da Siva.”  SL said D spoke to her and they made arrangement during the day and were going to meet at night on Saturday. Officer Smith didn’t collect clothing as SL was not sure if she would aide in prosecution.  SL didn’t agree to a medical exam.

SL didn’t bring clothing to Officer Smith in a bag.  SL indicated D forced her legs apart with his legs.  SL described D held her arms using his arms on her wrists.  SL didn’t show any injuries to wrists or legs.  D asked to use computer.  SL told Officer Smith that D asked to look in her bedroom and then the alleged assault took place.  SL told Officer Smith that D never used the computer.

SL told Officer Smith  that D went to her bedroom.  SL followed him in and asked to go back to the Congress.  SL said her room was messy.
