DIRECT of JOSE ENRIQUE ALVAREZ

Mr. Jose Alvarez is 32 years old.  He went to college and is a filmmaker and salsa instructor.  He has been dancing salsa since 1997.  Mr. Alvarez knows D from salsa competitions, first at a nightclub.  D approached Mr. Alvarez and his dance partner, Christina Santana.  At the time, Mr. Alvarez lived, and still does, in San Diego.  D said to them, “Whenever you come back you can have my house.”  Mr. Alvarez was shocked by D’s friendliness and generosity.  Mr. Alvarez and his dance partner Ms. Santana stayed at D’s house within the following month and another 25 times.  In the next few months, they were going back and forth from Los Angeles to San Diego. 

Mr. Alvarez met FM during this time.  FM and her friend Alien, D’s dance partner at the time, were rehearsing for a performance in D’s living room.  Alien was dating D and they were living together.  On the 25 occasions Mr. Alvarez went to D’s house he saw FM there only that once.  That day FM and Alien were in a rush.  D was going in and out of the house.  FM went upstairs and said, “I’m going to take a shower.”  Alien did too.  They got ready and left.  Mr. Alvarez saw FM talk to D.  This was in 2009.  They “crossed words”.  Mr. Alvarez cannot remember the details of the conversation.  It was not an uncomfortable conversation.  Mr. Alvarez saw FM again when his dance partner Ms. Santana competed in Vegas (?) style dance competition.  At the 2009 El Barrio Competition at Hollywood Park Casino, Mr. Alvarez saw D and FM there.
